<div class="content"><span style="padding-left: 50px;">(COLUMBIA, MO)</span> - The City of Columbia City Clerk issued the following proclamation following a tie during the April 5, 2022, election for Ward 3 Council Member. The City Clerk has ordered a special election to be held Tuesday, Aug. 2, 2022. <br /><br />A copy of the proclamation, as well as a copy of the form of the Notice of Election, are attached. <br /><br />The proclamation reads:<br /><br />"WHEREAS, on April 5, 2022, a general municipal election was held in the City of Columbia, Missouri, to elect the following three municipal officers: Council Member-at-large (Mayor), Ward 3 Council Member, and Ward 4 Council Member; and<br /><br />WHEREAS, the votes cast in the election for the Ward 3 Council Member resulted in a two-way tie vote between Karl Skala and Roy Lovelady, as set forth in the certification of election results issued by the Election Authority, which is attached hereto as Exhibit A; a
nd<br /><br />WHEREAS, neither of the candidates have requested a recount of the votes cast at the municipal election for Ward 3 Council Member by the Election Authority; and<br /><br />WHEREAS, Section 115.517.3 RSMo. provides that the officer with whom such candidates filed their declaration of candidacy shall issue a proclamation stating the fact there were an equal number of votes cast for election to the office and order a special election to determine which candidate is elected to the office unless the candidates agree to the alternative procedures set forth in Section 115.517.4 RSMo.; and<br /><br />WHEREAS, the candidates have not agreed to the alternative procedure authorized by Section 115.517.4 RSMo.; and<br /><br />WHEREAS, the City Clerk is the officer with whom the candidates for Ward 3 Council Member filed their declaration of candidacy in the City of Columbia, Missouri;<br /><br />NOW THEREFORE, 1, Sheela Amin, City Clerk of the City of Columbia, Missouri, do
hereby issue this proclamation declaring an equal number of votes were cast for Ward 3 Council Member at the April 5, 2022 municipal election and order a special election to be conducted by the Clerk of the County Commission and Election Authority in and for the County of Boone County, State of Missouri, on Tuesday, August 2, 2022, for the Ward 3 Council Member. The candidates to be voted on at such election shall be Karl Skala and Roy Lovelady. The special election shall be conducted and the votes counted as in other elections. The form of the Notice of Election shall be substantially as set forth in Exhibit B attached hereto.<br /><br />IN WITNESS WHEREOF, I have hereunto set my hand and caused to be affixed hereto the seal or the City or Columbia, this 15th day of April, 2022."</div>
